Terms of Service

1. Acceptance of Terms

By accessing and using the services of Ligulbacch Canada ("Company," "we," "our," or "us"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services Description

Ligulbacch Canada provides professional moving and loader services including, but not limited to:

  • Residential and commercial moving services
  • Packing and unpacking services
  • Storage solutions
  • Long-distance moving services
  • Specialized item handling
  • Loading and unloading services

3. Booking and Estimates

3.1 Estimates

All estimates provided are based on the information you supply and are subject to change upon actual inspection of items and services required. Estimates are valid for 30 days from the date of issue unless otherwise specified.

3.2 Binding vs. Non-Binding Estimates

  • Binding Estimates: The final cost will not exceed the estimated amount, provided the inventory and services remain unchanged.
  • Non-Binding Estimates: The final cost may vary based on actual services provided and items moved.

3.3 Booking Confirmation

Services are confirmed upon receipt of signed contract and any required deposit. We reserve the right to cancel or reschedule services with reasonable notice due to circumstances beyond our control.

4. Customer Responsibilities

4.1 Preparation

You are responsible for:

  • Providing accurate inventory and service requirements
  • Ensuring access to both pickup and delivery locations
  • Disconnecting appliances and utilities as required
  • Removing personal and valuable items (cash, jewelry, important documents)
  • Providing necessary permits or permissions for parking and building access

4.2 Prohibited Items

We will not transport the following items:

  • Hazardous materials (flammable, explosive, corrosive substances)
  • Perishable food items
  • Live plants (for long-distance moves)
  • Personal or sentimental items of extraordinary value
  • Illegal items or contraband
  • Items prohibited by law or regulation

5. Payment Terms

5.1 Payment Schedule

  • Local moves: Full payment due upon completion of services
  • Long-distance moves: Deposit required upon booking, balance due before delivery
  • Storage services: Monthly payments due in advance

5.2 Accepted Payment Methods

We accept cash, certified checks, money orders, and major credit cards. Personal checks may be accepted with prior approval.

5.3 Late Payments

Late payments may result in storage charges, liens on goods, and additional fees as permitted by law.

6. Liability and Insurance

6.1 Basic Coverage

Our basic liability coverage is $0.60 per pound per item. This coverage is included at no additional charge but provides minimal protection.

6.2 Full Value Protection

Full Value Protection is available for an additional fee and provides comprehensive coverage for your belongings at their current market value.

6.3 Customer Insurance

We strongly recommend that customers verify their homeowner's or renter's insurance coverage for moving-related damages.

6.4 Liability Limitations

Our liability is limited to the declared value of your shipment and the coverage option selected. We are not liable for:

  • Acts of God, natural disasters, or extreme weather conditions
  • Delays caused by circumstances beyond our control
  • Items not properly prepared for moving
  • Pre-existing damage to items
  • Consequential or incidental damages

7. Claims and Disputes

7.1 Damage Claims

Claims for lost or damaged items must be filed in writing within 9 months of delivery. A detailed inventory of damages and supporting documentation must be provided.

7.2 Dispute Resolution

Any disputes arising from our services will be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association. The arbitration will take place in Toronto, Ontario.

8. Cancellation and Rescheduling

8.1 Customer Cancellation

  • More than 7 days before scheduled move: No cancellation fee
  • 2-7 days before scheduled move: 25% of estimated cost
  • Less than 48 hours before scheduled move: 50% of estimated cost
  • Same day cancellation: 100% of estimated cost

8.2 Rescheduling

Rescheduling requests made with less than 48 hours notice may result in additional charges.

9. Force Majeure

We are not liable for delays or inability to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor disputes, equipment failures, or other force majeure events.

10. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy. By using our services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

11. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Ligulbacch Canada and is protected by Canadian and international copyright laws.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific services giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Ligulbacch Canada from any claims, damages, or expenses arising from:

  • Your breach of these Terms
  • Your negligent or wrongful conduct
  • Third-party claims related to your use of our services
  • Violation of any laws or regulations

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any legal proceedings must be brought in the courts of Ontario, Canada.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable.

16. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the modified Terms.

17. Entire Agreement

These Terms, together with our Privacy Policy and any signed service contracts, constitute the entire agreement between you and Ligulbacch Canada regarding our services.
